Hearst Media Services, LEGAL NOTICE BROOKFIELD WATER POLLUTION CONTROL AUTHORITY HIGH MEADOW SEWER EXTENSION NOTICE OF LEVY OF BENEFIT ASSESSMENTS: HIGH MEADOW CONDOMINIUM, LEDGEWOOD CONDOMINIUM AND NEWBURY CROSSING CONDOMINIUM Notice is hereby given that the Brookfield Water Pollution Control Authority, pursuant to Sections 7-249 and 7-250 of the General Statutes, has levied a Benefit Assessment against the properties, and the owners thereof, that have been especially benefited by the construction of the High Meadow Sewer Extension. The properties against which such benefit assessments have been levied are all of the properties located on Ledgewood Drive, East View Road, Pond View Road, Westview Lane, Arbor Drive, Boxwood Drive, Douglas Drive, Lambert Lane, Bristol Path, Brooks Lane and Comstock Trail within High Meadow Condominium, Ledgewood Condominium and Newbury Crossing Condominium. The principal amount of each such Benefit Assessment equals 8.8 percent (8.8%) of such property's assessed value on the October 1, 2014 Grand List of the Town of Brookfield. An individual listing of all such Benefit Assessments is contained in a Notice of Benefit Assessments filed for public inspection in the Office of the Brookfield Town Clerk. A Notice of Benefit Assessments listing each individual benefit assessment was filed in the Office of the Brookfield Town Clerk on July 17, 2015. Any person claiming to be aggrieved by such benefit assessment may appeal to the Superior Court for the Judicial District of Danbury within twenty-one (21) days of the filing of said notice of said benefit assessments in the Office of the Brookfield Town Clerk as provided by Section 7-250 of the General Statutes. Notice is also given pursuant to Section 7-252 of the General Statutes that such benefit assessments shall be due and payable on September 1, 2015; provided however, that at the option of the property owner, the benefit assessment may be paid in twenty (20) equal installments of principal, the first of which shall be due on September 1, 2015, and each subsequent installment shall be due on June 1 next ensuing commencing on June 1, 2016, together with interest on the unpaid principal amount of such benefit assessment at the rate of 3.0% per annum or at such other rate of interest not to exceed the maximum rate of interest which the Town of Brookfield is obligated to pay to finance said project as determined by the Authority to be appropriate; provided, however, that if any such installment remains unpaid for thirty (30) days after the same shall become due and payable, then at the option of the Authority, the entire unpaid balance of such benefit assessment, together with all unpaid interest, shall become immediately due and payable. In addition, the Authority shall have all of the rights provided by Section 7-254 of the Connecticut General Statutes, as amended, with respect to delinquent assessments.
